General Terms and Conditions

INTRODUCTION

Any ticket order on the site tickets.fabrique-lumieres.com is subject to the general visitor terms and conditions below. We recommend the Customer to read them carefully. Placing an order implies that the Customer has prior knowledge of these general visitor terms and conditions and constitutes a full and irrevocable acceptance of these terms and conditions.

These general visitor terms and conditions are drawn up in both Dutch and English. In case of any discrepancy between the two aforementioned versions, the Dutch version shall prevail.

ARTICLE 1: ACCEPTANCE OF GENERAL VISITOR TERMS AND CONDITIONS

The purpose of these general terms and conditions is to set out the rights and obligations of the various parties in connection with online ticket sales on the site tickets.fabrique-lumieres.com and these terms and conditions shall apply to any agreement between Culturespaces Netherlands B.V. and the Customer. Deviations from these terms and conditions are valid only if expressly agreed in writing. These general visitor terms and conditions also apply to special activities outside regular opening hours and/or aimed at other than regular visitors, in the case of exclusive receptions such as room hire, catering and the like.

Prior to confirming their order, the Customer declares to have taken note of these general terms and conditions. An order confirmation implies the acceptance without reservation of these general terms and conditions.

Culturespaces Netherlands B.V. reserves the right to amend or change these general terms and conditions at any time. If a change is made, in case of an order the general visitor terms and conditions in force on the day of the order will be applied.
Fabrique des Lumières is an exhibition of Culturespaces Netherlands B.V. The exhibition takes place at the Zuiveringshal West, Westergas. The address is Pazzanistraat 37, 1014 DB in Amsterdam, the Netherlands. Where the term Fabrique des Lumières is used in these terms and conditions, it shall also mean Culturespaces Netherlands B.V.

ARTICLE 2: ACCESS

2.1 Ticket

The Customer is only entitled to enter Fabrique des Lumières on presentation of a valid ticket. The Customer is obliged to show the ticket to an employee of Fabrique des Lumières upon request. If the Customer is unwilling or unable to comply with such a request, he may be denied access to Fabrique des Lumières, with no right to a refund.

2.2 Reselling

Reselling of tickets is not allowed without prior permission from Fabrique des Lumières.

2.3 Loss of ticket

The Customer will not receive a refund of the entrance fee in case of loss or theft of the ticket before the Customer has entered Fabrique des Lumières.

2.4 Denial of access

The Customer may be denied access to Fabrique des Lumières if they are under the influence of alcohol, narcotics or similar substances.

2.5 Access control

Fabrique des Lumières reserves the right to subject any Customer and their luggage to an access control before granting access to Fabrique des Lumières. In this regard, the Customer may be requested to cooperate in a search of bags and the like by or on behalf of Fabrique des Lumières employees. A Customer who fails to cooperate in a bag search may be denied access to Fabrique des Lumières and is not entitled to a refund of the ticket.

ARTICLE 3: STAY AT FABRIQUE DES LUMIERES

3.1 Own risk

The Customer's stay at Fabrique des Lumières is at their own expense and risk.

3.2 Children

Parents or supervisors of children are at all times responsible and accountable for the behaviour of the children they bring with them. Children under 12 may visit Fabrique des Lumières only if accompanied. Per adult, a maximum of two children under the age of 5 are allowed free of charge.

3.3 (Domestic) animals

In connection with the safety of (domestic) animals and visitors to Fabrique des Lumières, (domestic) animals are not allowed inside Fabrique des Lumières. Fabrique des Lumières does not provide shelter for (domestic) animals. However, assistance dogs are allowed at Fabrique des Lumières, provided this is indicated in advance.

3.4 Photography and filming

Other than with the prior written consent of Fabrique des Lumières, the Customer is not allowed to take photographs, video and film recordings during their visit to Fabrique des Lumières.

3.5 Smoking

The Customer is not allowed to smoke during their visit to Fabrique des Lumières.

3.6 Unsuitable objects

Bringing and/or carrying umbrellas, (large) backpacks, child carriers, prams and carrying other large objects is not allowed in the exhibition halls of Fabrique des Lumières.

3.7 Customer liability

The Customer is liable for any damage they cause to the Fabrique des Lumières building or exhibition.

3.8 Customer behaviour

During the stay at Fabrique des Lumières, the Customer shall at all times behave in accordance with the rules of public order, the guidelines of the National Institute for Public Health and the Environment (RIVM), the (house) rules of Fabrique des Lumières, directions and instructions of the Fabrique des Lumières staff, good morals and the rules of decency applicable in relation to the nature of the activity visited.

ARTICLE 4: Limitation of liability

4.1 Limitation of liability

Fabrique des Lumières shall only be liable for damage suffered by the Customer if and insofar as such damage is a direct consequence of gross negligence or intent on the part of Fabrique des Lumières. The liability shall in any case be limited to the lower of the following two amounts:
1.  1. The amount paid by Fabrique des Lumières' insurer to Fabrique des Lumières in respect of that individual claim;
2.  The compensation paid by a third party to Fabrique des Lumières in respect of that individual claim.

4.2 Damage to or loss of property

Fabrique des Lumières shall not be liable for damage to or loss of goods handed in for safe keeping by the Customer.

ARTICLE 5: TICKETS  

5.1 Services to which the tickets give entitlement

A ticket gives access to Fabrique des Lumières' exhibitions for a certain length of time.

5.2 Period of validity of tickets issued

Each ticket issued is valid only for the duration of time indicated on it.

5.3 Availability of tickets

The Customer shall be informed of the availability of the desired number of tickets during their order.

ARTICLE 6: RATES AND PRICES

Fabrique des Lumières offers different admission rates depending on the type of visit and the visitor's age or situation.
The applicable admission rates are those listed on the Fabrique des Lumières website at the time of ordering.
The total price when confirming the order is the final price, VAT and management fees included.
Free admission for children under 5 years of age applies to individuals only.
Entry fees and the total price of the order are given in euros. Fabrique des Lumières reserves the right to change rates at any time.

ARTICLE 7: ORDERING

The online ordering procedure consists of the following steps:

1/ The Customer selects the ticket(s) of their choice. 
For each ticket, the Customer chooses the number of entries at a certain rate and the day and time of the visit.

2/ The Customer provides the information necessary to process the order: the surname, first name and e-mail address.

3/ After checking the order and perusing the general visitor terms and conditions, the Customer proceeds to pay for the order. The Customer may use the payment methods listed below. Payment methods may be changed from time to time. 

  • • The option to pay by credit card, after which the Customer enters their credit card details, such as name, card number and expiry date and clicks on the agree button; or
  • • The option of payment via iDeal, after which the Customer selects the bank they bank with, clicks on the agree button and completes the online payment via their bank.

If payment is refused, the order will automatically be cancelled.
Payment of the order by the Customer constitutes acceptance of the order. The order cannot be revoked.

4/ The Customer receives an order confirmation e-mail.

ARTICLE 8: PAYMENT METHODS AND PAYMENTS

8.1 Payment method

Tickets shall be paid for exclusively in euros and subject to Article 7.

8.2 Payment process

The amount of the order will be debited from the Customer's bank account as soon as it is accepted by the bank.

8.3 Proof of order

Once the transaction is completed, the Customer will receive a proof of order by e-mail to the e-mail address provided during the ordering process.

8.4 Payment security

Payment is made on secure servers of our partner Adyen. This means that Customer bank details do not go through the site tickets.fabrique-lumieres.com.
The (payment) data are encrypted using the Secure Socket Layer (SSL) protocol, and are never sent unencrypted. At no time do CM and Fabrique des Lumières have access to these data or store them on their servers.

ARTICLE 9: CONFIRMATION OF THE ORDER

Once the bank has confirmed payment of the order, the Customer will receive an order confirmation e-mail. 
The confirmation e-mail confirms receipt of the order and contains the following information: 
- the date and time of the order; 
- the main features of the ticket(s) sold; 
- the attached ticket(s) in the form of a pdf document. 

ARTICLE 10: DELIVERY OF TICKETS 

The Customer has the following options for ticket delivery: 
- download from our website on the thank you page, by clicking on the 'Download' button next to the ticket(s). This can be done immediately after the order and payment have been completed.
- download from the confirmation e-mail sent to the e-mail address provided during the ordering process.
Note: the Customer can show the ticket(s) on their smartphone, or printed out. To print the ticket(s), the customer must have a printer capable of printing on white A4 paper. The Customer can choose to print their ticket(s) in black and white or in colour.

ARTICLE 11: TERMS OF USE FOR TICKETS 

Each ticket is systematically checked at the venue entrance. This check consists of scanning the QR code printed on the ticket (digital code). On the day of the visit, the Customer should check that:
- the ticket is properly printed in colour or black and white on a blank sheet of A4 paper - or clearly visible on a smartphone; and
- the ticket contains a legible QR Code and data (type of visit, validity period of the ticket, first and last name of the ticket bearer).
A ticket that is partially printed or is dirty, damaged or illegible will not be accepted.
A discounted ticket should be presented along with proof of that discount.
The ticket is valid only for the visit and start time stated on it. The ticket should be kept until the end of the visit.

FABRIQUE DES LUMIÈRES RESERVES THE RIGHT TO REFUSE ENTRY TO FABRIQUE DES LUMIÈRES IF A TICKET IS PRESENTED THAT DOES NOT COMPLY WITH ANY OF THE ABOVE CONDITIONS. 

ARTICLE 12: UNLAWFUL USE - LOSS - THEFT OF TICKETS

It is expressly forbidden to reproduce, copy or replicate tickets in any way. Counterfeiting a ticket is prohibited and a forged ticket is unusable. 
Anyone who illegally counterfeits a ticket and/or uses a forged ticket will face criminal prosecution. 
Fabrique des Lumières will refuse access to the venue to any bearer of a ticket that contains a barcode that has already been scanned.

ARTICLE 13: CONDITIONS FOR REFUNDS AND EXCHANGE OF TICKETS

The date and/or start time of individual tickets can be changed at any time before the date and time indicated on the ticket. This depends on the validity of the service stated on the ticket. Individual tickets cannot be refunded or exchanged for another exhibition, service or rate.

Any ticket change request must be made on the CM Global online self-service ticket support page or via CM Global customer service.

In case of cancellation of the service stated on the ticket by Fabrique des Lumières, the customer service shall inform the Customer as soon as possible via e-mail and make the Customer a proposal: 
- if possible, while keeping the ticket: rescheduling the relevant service to another day and/or time; or 
- refunding the relevant ticket, specifying the refund method.

ARTICLE 14: GROUPS

14.1 Rate setting

Rates are stated in euros, include VAT and, unless otherwise specified, are per person. Rates are subject to change at any time.

To qualify for the group rate, the group should consist of at least 12 paying persons (these are the persons not eligible for free admission).

  • Group of adults: this rate applies to all groups of people aged 18 and over.  
  • Group of children: this rate applies to all groups of people aged 5 to 17.
  • School group: this rate applies to groups of students or pupils accompanied by one or more teachers. The school group rate applies only to group visits organised by a school.

14.2 Reservation

A reservation is required for groups (from twelve (12) paying persons). Reservations should be made via the website tickets.fabrique-lumieres.com or by emailing the sales department at groepen@fabrique-lumieres.com.
Each group reservation request should include the number of visitors, the name and contact details of the group leader, the date, the start time and the desired service.

14.3 Access conditions for groups

 To qualify for the group rate, the group should consist of at least 12 paying persons (these are the persons not eligible for free admission).

On the day of the visit, only the group leader should report to the ticket counter with the booking confirmation e-mail and the payment method (if the booking was not paid through online ticket sales). Any additional services can be purchased on site, subject to availability at the time of purchase.

If a group arrives fifteen (15) minutes late, this shall be considered a cancellation unless the next start time is available. A cancellation must be notified at least two (2) working days before the visit date. If the cancellation is notified less than two (2) days prior to the visit date, a cancellation fee will be charged. 

14.4 Cancellation conditions for group visits

Group tickets can be changed up to two (2) working days before the reserved visit date and time by sending an e-mail to groepen@fabrique-lumieres.com. This depends on the validity of the service stated on the ticket. Any overrun of more than fifteen (15) minutes, or non-appearance of a group shall be considered a cancellation and will not be refunded unless the next start time is available.

ARTICLE 15: PERSONAL DATA PROTECTION

When placing an order, the Customer's personal data are requested (first name, surname and the Customer's e-mail address). 
These data are necessary for the processing and follow-up of the order in question and are also used in the event of a suspension or cancellation of the service to which the ticket gives access. 
Personal data will only be processed in accordance with applicable privacy and regulatory requirements including the General Data Protection Regulation (GDPR). Fabrique des Lumières has taken appropriate technical and organisational measures to protect personal data against loss or against any form of unlawful processing. 
Personal data are kept for no longer than is strictly necessary to achieve the purpose for which they were collected. All data collected for the purpose of purchasing our products and/or services will be deleted as soon as possible after completion of that purchase.
In some cases, data must be kept for a certain legal period. If the destruction of data is not technically possible, they will be anonymised as far as possible.
The Customer has the right to access, modify, rectify and delete their data at any time. The Customer can exercise these rights by sending a request to customer service: service@fabrique-lumieres.com, which will then contact them to arrange the necessary actions at tickets.fabrique-lumieres.com.

ARTICLE 16: ENTIRETY OF GENERAL VISITOR TERMS AND CONDITIONS 

These general visitor terms and conditions constitute the entire agreement and understandings relating to its subject matter and supersede all previous written and/or oral agreements and understandings between the Customer and Fabrique des Lumières. 
If any term or provision of these general visitor terms and conditions is declared invalid, void or unenforceable in any way, all other terms and conditions shall remain in full force and effect and shall in no way become invalid, affected or influenced thereby.

ARTICLE 17: DISPUTES AND COMPLAINTS

These general visitor terms and conditions are governed exclusively by Dutch law. 
Any complaints should be adequately made known in such a way as to preserve evidence of the reason for the dispute, stating the reason for dissatisfaction and the order number. Any complaint should be addressed to Fabrique des Lumières (Culturespaces Netherlands B.V.) and sent by post within one week of the visit at the latest to the following address:

All disputes arising from or in connection with these general visitor terms and conditions and/or further agreements resulting therefrom shall be submitted in the first instance exclusively to the District Court of Amsterdam, subject to appeal and cassation.
